Excellence Recovery LLC is committed to protecting the privacy and security of your Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and all relevant state and federal confidentiality laws.

Use and Disclosure of Protected Health Information (PHI)

PHI includes any information in your medical record that identifies you and relates to your physical or mental health, treatment, or payment history. This can include your diagnosis, care plan, clinical notes, and insurance information.

We may use or disclose your PHI in the following situations:

  • Treatment: To coordinate care within our facility or with other licensed professionals involved in your care.
  • Payment: To obtain payment from your health plan or other sources.
  • Healthcare Operations: To support administrative tasks, staff training, internal quality review, and service improvement efforts.

Authorization for Other Uses

Any use or disclosure of your PHI not described above requires your written authorization. You may revoke this authorization at any time by submitting a written request.

Your Rights Under HIPAA

As a client of Excellence Recovery LLC, you have the following rights regarding your Protected Health Information:

  • Right to Access: You may request a copy of your medical records in paper or electronic format.
  • Right to Amend: You may request corrections if you believe your records are incomplete or incorrect.
  • Right to an Accounting of Disclosures: You may request a list of certain disclosures made without your authorization.
  • Right to Request Restrictions: You may ask us to limit how your PHI is used or disclosed, including limiting disclosures to health plans if you paid for a service out-of-pocket.
  • Right to Confidential Communications: You may request to be contacted at a specific location or in a specific manner.
  • Right to a Paper Copy: You may request a printed copy of this privacy policy at any time, even if you previously agreed to receive it electronically.

Safeguards and Security

All staff at Excellence Recovery LLC are trained in HIPAA compliance and sign confidentiality agreements upon hire. Medical records are securely stored in locked physical files and encrypted digital systems. Access is limited to authorized personnel only.

We use HIPAA-compliant platforms for medical records, telehealth, and insurance processing. Any outside vendors (e.g., billing, hosting, or software partners) are required to sign Business Associate Agreements (BAAs) confirming HIPAA compliance.

Disclosures Without Authorization

Federal and state law allows certain disclosures of your PHI without your consent, including:

  • As required by law
  • Reporting suspected child abuse or neglect
  • Preventing serious threats to health or safety
  • Court orders or legal subpoenas
  • Public health reporting
  • Medical emergencies
  • National security or intelligence purposes

Violations and Breaches

If there is ever a breach involving your unsecured PHI, Excellence Recovery LLC will notify you in accordance with HIPAA guidelines. Any staff member who violates this policy is subject to disciplinary action, up to and including termination.
